Terms of Service

1. Acceptance of Terms

By accessing or using TubeMind (the "Service"), including our Chrome extension and web application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and TubeMind, operated from France. By using the Service, you represent that you are at least 16 years old and have the legal capacity to enter into these Terms.

2. Description of Service

TubeMind is an AI-powered learning tool that helps you learn more efficiently from YouTube videos. The Service includes:

• AI Summaries: Automatic generation of video summaries and key points
• Interactive Chat: AI-powered Q&A about video content
• Quiz Generation: Automated quizzes to test your understanding
• Notes: Timestamped note-taking on videos
• Export: Export capabilities to Notion and other formats

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Credit System and Billing

4.1 Credit System

TubeMind operates on a credit-based system. Credits are consumed when you use AI-powered features:

• Video Summary: 10 credits per video
• AI Chat Message: 5 credits per response
• Quiz Generation: 15 credits per quiz

4.2 Subscription Plans

We offer the following subscription plans:

• Free: 50 credits per month
• Pro: 500 credits per month - €9/month or €90/year
• Ultimate: 2,000 credits per month - €19/month or €190/year

Credits are refreshed monthly on your billing date. Unused credits do not roll over to the next month.

4.3 Credit Packs

You may purchase additional one-time credit packs. Credit packs do not expire and are consumed after your monthly credits.

4.4 Payment Processing

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's Terms of Service.

4.5 Refund Policy

Subscription fees are non-refundable except where required by law. If you cancel your subscription, you will retain access to paid features until the end of your current billing period. For credit pack purchases, refunds may be considered on a case-by-case basis for unused credits within 14 days of purchase.

5. Free Trial

New users may receive a 3-day free trial of Pro features. After the trial ends, you will automatically revert to the Free plan unless you subscribe. No payment is required to start a trial, and you will not be charged automatically after the trial ends.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to violate any laws or regulations
• Attempt to circumvent any security measures or access restrictions
• Use automated tools or bots to access the Service beyond normal use
• Share your account credentials with others
• Resell, redistribute, or commercially exploit the Service
• Use the Service to process videos you do not have rights to access
• Abuse the credit system or exploit bugs for unfair advantage
• Upload or transmit malicious code or content

7. AI-Generated Content

The Service uses artificial intelligence to generate summaries, chat responses, and quizzes. You acknowledge that:

• Accuracy: AI-generated content may contain errors, omissions, or inaccuracies. It should not be relied upon as the sole source of information.
• No guarantee: We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
• Educational purpose: AI content is provided for educational and informational purposes only.
• Verification: You are responsible for verifying any important information from AI-generated content against original sources.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by TubeMind and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8.2 Your Content

You retain ownership of any notes, tags, or other content you create using the Service. By using the Service, you grant us a limited license to store and process your content to provide the Service.

8.3 YouTube Content

TubeMind processes publicly available YouTube video data. All YouTube content remains the property of its respective creators and is subject to YouTube's Terms of Service. We do not claim ownership of any YouTube content processed through the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may:

• Perform maintenance that temporarily affects availability
• Modify, suspend, or discontinue features with reasonable notice
• Experience outages due to circumstances beyond our control

We are not liable for any loss or inconvenience caused by service interruptions.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months before the claim
• We are not liable for any loss of data, profits, or business opportunities

These limitations do not affect your statutory rights under applicable consumer protection laws.

12. Indemnification

You agree to indemnify and hold harmless TubeMind from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

You may close your account at any time through your account settings or by contacting us. We may terminate or suspend your account if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. You may request deletion of your personal data in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.

For EU consumers: You may also have rights under the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
